The family of Landon Embry, a motorcyclist who tragically lost his life in a 2022 collision involving a Tesla Model 3 operating on Autopilot, has filed a lawsuit against Tesla and the vehicle’s driver. The incident, which occurred in Utah, raises critical questions on the protection and reliability of Tesla’s driver assistance systems.

Incident Details

Landon Embry, 34, was riding his Harley Davidson when the Tesla Model 3, traveling at speeds between 75 and 80 miles per hour, struck the rear of his motorcycle. The impact threw Embry from his bike, leading to his immediate death on the scene. In line with the lawsuit, the motive force of the Tesla was fatigued and never in an appropriate condition to operate the vehicle safely.

The lawsuit, filed in state court in Salt Lake City, alleges that Tesla’s Autopilot and other safety features are “defective and inadequate.” The plaintiffs argue that the Autopilot system must have detected the motorcycle and prevented the collision. “A fairly prudent driver, or adequate auto braking system, would have, and will have slowed or stopped without colliding with the motorcycle,” the grievance asserts.

Growing Scrutiny of Tesla’s Autopilot

This incident adds to the increasing scrutiny surrounding Tesla’s Autopilot and Full Self-Driving systems. Just this week, police reported that a Tesla Model S operating in “Full Self-Driving” mode struck and killed a 28-year-old motorcyclist within the Seattle area. Moreover, in April, Tesla settled a lawsuit related to a 2018 crash that resulted within the death of an Apple engineer after his Model X, also on Autopilot, veered off a highway near San Francisco.

The Embry family’s lawsuit underscores a critical concern: the power of Tesla’s driver assistance technology to acknowledge and reply to potential hazards effectively. The grievance highlights that the Autopilot’s sensors, including cameras, must have identified the motorcycle and brought appropriate motion to avoid the collision.

Tesla’s Response and Implications

As of now, Tesla has not issued a comment regarding the lawsuit. The end result of this case could have significant implications for the long run of autonomous driving technology and regulatory oversight. If the court finds Tesla’s systems at fault, it may lead to stricter regulations and modifications to enhance the protection of those advanced driving aids.
